MSP Portal Terms of Use

General

Please read these terms of use (“Terms”) carefully before using the MSP Portal (“Portal”) provided by Commvault Systems Inc. and its subsidiaries (collectively “Commvault”). The Portal is for use by Commvault’s authorized managed service providers solely in connection with their provision of a managed service offering that includes Commvault’s Metallic Saas Service.  Information on the Portal is to be used only for the purpose of facilitating these offerings.  By accessing or using this site, you acknowledge that you have read, understood and agree to be bound by these Terms, the terms of the MSP Agreement, and applicable laws and regulations including United States export laws and regulations. The Terms govern your use of the Portal and any text, information or services that Commvault may make available through the Portal. Commvault may change the Terms from time to time in its sole discretion without notice. Access to the Portal is granted at Commvault’s sole discretion and may be revoked at any time and is available only to you if you have accepted the terms and conditions in the MSP Agreement.

Ownership

You agree and acknowledge that the information supplied to you by Commvault through the Portal shall constitute confidential proprietary information and shall remain the exclusive property of Commvault.

Links to Third Party Sites

The Portal may contain links to other websites (“linked sites”). The linked sites are not under the control of Commvault and Commvault is not responsible for the contents of any linked site, including without limitation any link contained in a linked site, or any changes or updates to a linked site. The inclusion of any link does not imply endorsement by Commvault of the site or any association with its operators. No Warranty

Commvault’s obligations with respect to its Metallic SaaS Services are governed by the MSP Agreement and any other agreements under which they are provided. If you or your end users obtain a product or service from Commvault that is provided without an agreement, that product or service is provided “as is” with no warranties whatsoever, express or implied, and your use of that product or service is at your own risk.

Information on the Portal is not promised or guaranteed to be correct, current or complete and the Portal may contain technical inaccuracies or other errors. Commvault assumes no responsibility for updating the Portal to keep information current or to ensure the accuracy or completeness of any posted information. You should confirm the accuracy and completeness of all posted information before making any decision related to any services, products or other matters described in the Portal.

UNDER NO CIRCUMSTANCES SHALL COMMVAULT OR ITS LICENSORS BE LIABLE FOR ANY TYPE OF DAMAGES OR CLAIMS RELATED TO THE PORTAL, INCLUDING BUT NOT LIMITED TO, INCIDENTAL, SPECIAL, PUNITIVE, INDIRECT OR CONSEQUENTIAL DAMAGES, EVEN IF COMMVAULT OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.
